Welcome to BlueSol Pools (“Company,” “we,” “our,” “us”). By accessing or using the website https://blusolpools.com and any related services, scheduling tools, or pool maintenance agreements, you agree to comply with and be bound by the following Terms of Service.

⚠️ IMPORTANT: These terms contain important disclaimers, limitation of liability, and dispute resolution provisions. Please read carefully before using our services. If you do not agree to these terms, please do not use our website or services.

1. Acceptance of Terms

By using BlueSol Pools’ website, booking appointments, or purchasing services, you represent that you are at least 18 years old and have the legal authority to enter into this agreement. These terms apply to all visitors, customers, and service recipients. We reserve the right to update these terms at any time without prior notice.

2. Services Provided

BlueSol Pools offers professional pool cleaning, maintenance, repair, equipment installation, water testing, chemical balancing, and related residential/commercial pool services. Specific service details, pricing, and availability are subject to change and will be confirmed at the time of booking. We reserve the right to refuse service to any customer for any lawful reason, including safety concerns or non-payment.

3. Estimates & Service Agreements

Any estimates provided via our website, email, or over the phone are valid for 30 days from the date of issuance. A formal service agreement will be provided before commencing any recurring or one-time services. Payment terms are detailed in invoices; late payments may incur a 1.5% monthly interest charge or service holds. All service agreements are binding once signed or accepted via electronic confirmation.

4. User Responsibilities

  • You agree to provide accurate, current, and complete information when requesting services or creating an account.
  • You must maintain safe access to pool equipment (clearing pathways, securing pets, providing gate access, etc.).
  • You must disclose any known hazards on your property before service begins.
  • Do not misuse the website by introducing viruses, hacking attempts, or overloading our infrastructure.
  • You are responsible for maintaining adequate water levels and functioning equipment unless otherwise agreed.

5. Cancellations & Refunds

Cancellations: For recurring maintenance, we require 24-hour notice for cancellation or rescheduling to avoid a cancellation fee of $50. For one-time services, cancellations with less than 24 hours notice may be subject to a $75 trip fee.

Refunds: Refunds for completed services are not provided unless due to verified performance issues documented within 48 hours of service. Any unused prepaid service credits are refundable within 14 days of purchase minus a 10% processing fee. Seasonal or annual contracts are non-refundable after 30 days.

6. Intellectual Property

All content, images, logos, graphics, text, videos, and software on blusolpools.com are the exclusive property of BlueSol Pools or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content without prior written consent from BlueSol Pools.

7. Limitation of Liability

To the maximum extent permitted by law, BlueSol Pools, its employees, affiliates, subcontractors, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, pool equipment damage, or pool downtime, arising out of your use of our services or website. Our total liability for any claim arising from these terms shall not exceed the total amount paid by you for services during the three (3) months preceding the claim.

8. Disclaimer of Warranties

Our website and services are provided on an “AS IS” and “AS AVAILABLE” basis. BlueSol Pools makes no representations or warranties of any kind, express or implied, regarding the operation or availability of our site, or the information, content, or service reliability. We do not warrant that the website will be error-free, secure, or free from viruses or other harmful components. However, we guarantee that our pool service technicians perform work in a professional, workmanlike manner per industry standards, and we will re-perform any unsatisfactory service at no additional cost if reported within 48 hours.

9. Indemnification

You agree to indemnify, defend, and hold harmless BlueSol Pools and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your violation of these Terms, (b) your misuse of the website or services, (c) your violation of any third-party rights, or (d) any injury or damage caused by hazards on your property not disclosed to us.

10. Third-Party Links & Integrations

Our site may contain links to third-party websites or services (e.g., payment processing through Stripe/PayPal, equipment manufacturers). We are not responsible for the content, policies, or practices of any third-party platforms. Your interactions with them are governed by their respective terms and privacy policies. We do not endorse or guarantee any third-party products or services.

11. Payment Terms

All payments are due upon receipt of invoice unless otherwise agreed in writing. Accepted payment methods include credit card, electronic check, and ACH transfer. A $35 fee will be charged for any returned checks or failed payments. We reserve the right to suspend services immediately for non-payment. Recurring service plans will be automatically billed on the 1st of each month.

12. Force Majeure

BlueSol Pools shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, natural disasters, weather conditions preventing safe pool access, pandemic, labor disputes, utility failures, or government restrictions.

13. Modifications to Terms

BlueSol Pools reserves the right to modify these Terms of Service at any time. If changes are material, we will post a notice on our website or send an email notification. Your continued use of our services after modifications become effective constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict of law provisions. Any legal action or arbitration arising out of these Terms shall be brought exclusively in the courts of Passaic County, New Jersey. Prior to litigation, you agree to attempt informal resolution by contacting us within 30 days of the dispute arising. If unresolved, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
